1.1.Definitions

PlayCherry Limited is a company duly registered under the laws of Malta; Registration C43059; licensed by MGA under the following licenses: MGA/CL1/824/2012 and MGA/CL1/825/2012 (issued on 4th October 2012), MGA/CL1/850/2012 (issued on 27th May 2013), MGA/CL1/905/2013 (issued on 17th March 2014) and MGA/CL1/975/2014 (issued on 2nd June 2014), MGA/CL2/1203/2016 (issued on 1st February 2017), MGA/CL1/1408/2017 (issued on 15th November 2017).

The term EuroLotto shall mean and refer to PlayCherry Limited;

All references to the Authority in this document shall be deemed to refer to the Malta Gaming Authority (“MGA”);

Agreement shall refer to the rules and terms of conduct contained in these Terms and Conditions;

Gaming shall have the same meaning attributed to it as in Legal Notice 176 of 2004 and shall refer to any agreement, scheme or arrangement between us and any other party to play together at a game of chance in which a prize or reward consisting of money or some other item of value, worth, advantage, or opportunity is offered or can be won and become the property of the winner under defined conditions established for the purpose of the game;

Player shall mean any person who is over eighteen (18) years of age and who takes part in remote gaming as defined above;

Player's Account shall mean a record kept by EUROLOTTO, which record shall be at all times accessible to the Player, which shows the Player's credit against such license holder, taking into account all wagers placed and all prizes won by such Player and any other debit or credits as may be permitted by these regulations and approved by the Authority;

Any reference to Games in this agreement shall refer to Casino and other Games as may from time to time become available on the Website. EUROLOTTO reserves the right to add and remove Games from the Website at its own discretion.

Words denoting the singular number shall include the plural and vice versa;

Words denoting any gender shall include all genders;

Clause headings are for ease of reference only and shall not affect the construction or interpretation of this Agreement.

1.2.Preamble

This Agreement is drawn up in the English language and may be translated into any language other than English provided that all versions reflect the same principles. In case of any discrepancies in interpretation the English text shall in any event prevail.

This Agreement supersedes all previous undertakings and arrangements entered into between the Parties (whether expressed or implied) and represents the entire Agreement between them in relation to its subject matter.

In the event that any of the terms, conditions or provisions contained in this Agreement shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision shall to that extent be severed from the remaining terms, conditions and provisions which shall continue to be valid to the fullest extent permitted by law. EUROLOTTO hereby agrees to attempt to substitute any invalid or unenforceable provision with a valid or enforceable provision which achieves to the greatest extent possible the economic, legal and commercial objectives of the invalid or unenforceable provision.

Any changes to the Agreement will be notified to the Player in advance, prior to such amendment taking affect. The Player shall have the right to refuse to accept the changes and in such case must notify EUROLOTTO by email to [email protected] in which case his account shall be closed in accordance with the terms of this agreement.  Default of such email shall amount to tacit approval of such changes.

1.3.Applicable law

This agreement is regulated by the laws of Malta.

EUROLOTTO is licensed and regulated in Malta by the Malta Gaming Authority. The MGA is the regulatory body for all forms of gaming in Malta. A Player has the right to bring unresolved disputes to the MGA via [email protected] For further information about the MGA, please go to www.mga.org.mt.

Any legal dispute shall be settled in accordance with the Governing Law of Malta.

1.4.Duration

This Agreement is valid until further notice.

2.1. Conditions

EUROLOTTO reserves the right to terminate and/or change bonuses and promotions at any time.

EUROLOTTO reserves the right to withhold and remove any bonuses awarded to the Player if such bonuses have not been used within 3 month from the date when they were awarded.

All bonuses issued by EUROLOTTO can only be used for playing and may not be transferred or paid out unless stated requirements within the bonus campaign are fulfilled.

The Player acknowledges and understands that separate terms and conditions exist with respect to promotions, bonuses and special offers, and are in addition to this Agreement. These terms are outlined in the relevant promotions pages.

All bonuses have an expiry date. If the bonus requirements are not fulfilled at the expiry date, the company reserves the right to cancel or debit the bonus credits from the account.

EUROLOTTO reserves the right to cancel/change/stop marketing promotions at any time without prior notice.

The Player may receive bonus money from the company should he agree to participate in a bonus promotion. The bonus money granted together with the real money that was used as qualification for the bonus money will be marked as applicable for game play in respect of that particular bonus only. This balance can only be used on products and games that are outlined in the bonus details page.

The player has the right to cancel a bonus offer from his/her account. In this case all winnings generated by the bonus money will also be cancelled.

Multiple participations to the same bonus campaign from the same device/household/IP address are not allowed. In case it is noted that there is abuse of bonuses or any other promotions, the bonus/promotion will be forfeited and any funds on the Players’ Account will be frozen. Furthermore, the Player Account may be closed by EUROLOTTO at its own discretion.

Voucher codes distributed by EUROLOTTO trigger a bonus promotion to the player account where the voucher is used.

EUROLOTTO reserves the right to withdraw any bonus money and VIP points from the Player's Account if the player has not logged in to his/her player account during the last six months.

EUROLOTTO reserves the right to withdraw the Bonus and the resulting profits if any term of the offer or promotion have been breached, furthermore, it may also withhold any other funds held in the player's account to make up for any losses incurred by EUROLOTTO due to the breach of the said conditions.

If the conditions above have been translated into various languages and these reflect the same principles, however, in case of any discrepancies between the different language versions, the English version shall prevail.

3.1. System errors and failures

A Player must inform EUROLOTTO as soon as he or she becomes aware of any errors with respect to the Player Account or any calculations with respect to any bet placed or any currency conversion.

In the event of any system failure or game error (a divergence from the normal functioning of the game logic for whatever reason) that results in an error in any odds calculation, charges, fees, bonuses or payout, or any currency conversion as applicable, ('System Error'), EUROLOTTO will seek to place all parties directly affected by such System Error in the position they were in before the System Error occurred.

EUROLOTTO reserves the right to declare null and void any bets that were the subject of such System Error and to take any money from the Account relating to the relevant bets. In all circumstances whereby EUROLOTTO (in its sole discretion) determines a System Error has been used to gain an unfair advantage, EUROLOTTO reserves the right to consider this activity to be subject forfeiture and account closure as per these Terms and Conditions.

3.2. Miscarried and aborted games

EUROLOTTO is not liable for any downtime, server disruptions, lagging, or any technical or political disturbance to the game play. Refunds may be given solely at the discretion of the management.

EUROLOTTO shall accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with website or its content; including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the site or its content or any errors or omissions in content.

In the event of a casino system malfunction all wagers are void. Should this situation apply, EUROLOTTO reserves the right to terminate events and/or games.

In the event a game is started but miscarries because of a failure of the system, EuroLotto shall refund the amount wagered in the game to the Player by crediting it to the Player Account or, if the account no longer exists, by paying it to the Payer in an approved manner; and  if the Player has an accrued credit at the time the game miscarried, credit to Player’s Account the monetary value of the credit or, if the account no longer exists, pay it to the Player in an approved manner.

3.3. Other limitations of liability

It is the Player’s responsibility to know that his Gaming is legal. It is up to the Player to know that gaming is legal in the current location.

EUROLOTTO reserves the right to limit or refuse bets.

EUROLOTTO is not responsible for:

  • Support of software or any accessories, attachments, machines, systems or other items;
  • Rectification of lost or corrupt data or programs arising for any reason;
  • Diagnosis and/or rectification of potential malfunctions or actual faults;
  • Corrections or data corruptions caused by third party software or software written by the Player, its agents or sub-Contractors.

EUROLOTTO provides no warranty or guarantee as to the suitability or quality of any goods or services supplied and the Player acknowledges that he has sole responsibility for the selection of them. Except as expressly provided in this Agreement, all conditions, representations and warranties (expressed or implied, statutory or otherwise) are excluded to the fullest extent permitted by law including without limitation any implied warranties or conditions as to quality or fitness for purpose.

EUROLOTTO shall not be liable for the following loss or damage howsoever caused and even if foreseeable:

  • Economic loss, which term shall include loss of profits, loss of use of profits, business, revenue, goodwill or anticipated savings;
  • Loss of, damage to or the cost of replacement, recovery or reconstruction of the Player's or a third party's documents, tapes, records, information or other data on any media;
  • Special, indirect or consequential loss;
  • Loss arising from any claim made against the Player by a third party;
  • Loss or damage arising from the Player's failure to fulfil his responsibilities or any matter under the control of the Player or a third party;
  • Loss or damage arising from EUROLOTTO acting in accordance with the instructions of the Player, agents or third parties engaged by the Player.

Neither EUROLOTTO nor the Player shall be liable for any loss or damage caused by delay or failure to fulfil its obligations under this Agreement where such delay or failure is due to any cause beyond the control of the parties, as the case may be, including (without limitation) acts of God, war or warlike action, civil disorder, insurrections or riots, fire, storm, flood, explosions, earthquakes, epidemics or quarantine restrictions, sabotage, government disorders, priorities or regulations affecting materials or facilities, court orders, restrictions as a consequence of decision or view taken by any governmental body or similar, strikes actual or threatened, labour troubles causing cessation, slowdown or interruption of work, inability to obtain necessary governmental or regulatory Authority approval, delay or cancellation of any commercial air service, or any cause to the extent it is beyond the parties' reasonable control.

Each Player is personally responsible for adhering to all applicable local legislation and rules as set out by national or local authorities from time to time. EUROLOTTO does not accept play from Players domiciled in the US or Players depositing using an US bank connection.

4.1. Account registration

It is the sole responsibility of the player to understand the laws in his/her jurisdiction of residence
relating to all aspects of playing at EUROLOTTO. The access to the site is on the own player’s initiative and
the player is responsible for their compliance with local laws if and to the extent local laws are
applicable. EUROLOTTO makes no representation that materials on the site or EUROLOTTO's services are
appropriate, available or allowed in the player’s jurisdiction. EUROLOTTO is unable to provide any legal
advice regarding this matter and EUROLOTTO accepts no responsibility whatsoever should an individual
act in breach of any law or regulation in transacting with EUROLOTTO in whichever manner.

To open a Player Account with EUROLOTTO the Player personally has to complete the online form and supply EuroLotto with the following:

  • Full name;
  • Nickname;
  • Address;
  • City;
  • Post code;
  • Country;
  • Contact email;
  • Phone number;
  • Date of birth - confirming that the Player is over 18 years of age.

The Player must keep the Account details up to date and can do so by modifying 'My Profile' under the ‘My Account tab or by sending an email to [email protected] for help.

EUROLOTTO does not accept Player registrations and / or deposits and / or play from the following countries: American Samoa, Bonaire, Canada, France, French Guiana, French Polynesia, Guadeloupe, Guam, Hungary, Martinique, New Caledonia, Reunion, Saint Barthelemy, Saint Martin (French), Saint Pierre and Miquelon, East Timor, United States of America, Wallis and Futuna, Italy, Spain, the Netherlands, Denmark, Israel, Belgium, United Kingdom, Austria, Thailand, Poland, Portugal, Turkey, Australia, and the Czech Republic.

EUROLOTTO does not accept registrations from Players under 18 years of age, or any other minimum age laid down by the laws of each country.  Registrations from Estonia in particular are only accepted if the Player is above 21 years of age.

Successful registration means requesting that EUROLOTTO opens a gaming account for the Player. EuroLotto shall open an account when requested as long as EUROLOTTO’s requirements are met and reserves the right to decline account opening for any reason. The account is intended for administering the Player's funds, play and fees, as well as tickets in play, refunds, winning payments, cash-outs and eventual service fees for the duration of the Agreement. The account is for use by the Player only and Players must have only one Player account. Players are prohibited from the selling/transferring and/or acquiring of accounts or funds to/from other Players.

In the event of a Player's death or permanent incapacity, EUROLOTTO requires a copy of the death certificate or a registered medical physician's statement and any other documents relating to administration or guardianship of the estate as proof of the Player's successor's or guardian's (jointly referred to as "Beneficiaries") entitlement. In this event, any of the Player's income rights and/or the value of the Player Account may be passed to the Beneficiaries.

EUROLOTTO reserves the right to monitor Player Account activities and notify the Player if EUROLOTTO believes he or she may have gambling problems. However, EuroLotto makes no warranties about its ability to identify and help a Player with gambling problems. The Player may request to be excluded from entering or using the EUROLOTTO web application for various reasons and may do so at any time by sending a request to [email protected].

EUROLOTTO reserves the right to refuse or close any application for a Player's Account. Any contractual obligations already made will be honoured.

4.2. Username and Password

Username and password are provided as a part of the registration procedure. At registration, the Player chooses a username and password. (The e-mail address supplied becomes the username.)

These details shall only be effective on acceptance of this Terms and Conditions by the Player. The Player accepts that the Player is solely responsible for maintaining the confidentiality of the Player's username and password, and shall store the username and password in such a manner that outside persons cannot gain access to them.

The Player is responsible for immediately contacting Customer Services, if there is a risk that the Player's username or password may be compromised in any way. Please contact EUROLOTTO by sending a message to [email protected], if you suspect anything.

EUROLOTTO reserves the right to temporarily lock the account under such conditions. The Player remains fully responsible for all play based on the Player's username and password until such locking of the Player's Account.

EUROLOTTO reserves the right to inactivate a Player's username and password at any time.

4.3. Closing Players’ Account

The Player may close his Player’s Account by sending such a request to [email protected].. The customer support team will then finalize the closing of the Player’s Account. The player will be able to open his/her account again by sending a request to the customer support team.

If a Player closes the Player's Account, all funds excluding any bonus money that might not be redeemable will be transferred to the bank account from where the funds originated.

EUROLOTTO shall maintain all Players’ information and transaction records in accordance with the relevant Malta laws and regulations including those under the Data Protection Act, Prevention of Money Laundry Act and the MGA regulations.

5.1. Handling and accounting for deposits

Registered Players can deposit funds using a VISA or MasterCard, by bank transfers or through e-wallets such as Moneybookers. The minimum deposit is €2. Once the deposit is processed it will be available on the Player's account immediately after approval. Bank transfers will not be credited to the Player account until the funds have reached our bank. EUROLOTTO does not impose any fees on deposits; however we are not liable for any fees charged by the Player's bank for online purchases. Information regarding deposit limits and processing times can also be found in the payments and FAQ section. The Player may be requested to provide EUROLOTTO with personal documentation, such as but not limited to copies of identification documents, utility bills, credit cards, bank statements etc

Funds deposited by Players shall be separately accounted for. EUROLOTTO separates deposits from its other funds and keeps Player deposits in a separate bank account. The Player hereby accepts that EUROLOTTO stores the deposited funds together with other Players' funds and that separation is only provided by electronic accounting methods. Acceptance of Player’s deposit shall be subject to the Player successfully completing EUROLOTTO’s “Know Your Client" procedures which shall be carried out on all Players depositing money.

Players are not allowed to make deposits with funds that have been obtained by ill-gotten means. Players are also advised that all transactions are monitored for irregularities and to prevent money laundering and fraud. EUROLOTTO has an obligation to report suspicious transactions to the appropriate authorities.

EUROLOTTO will not accept a wager from a player unless there are sufficient funds in the Player's Account to cover the amount of the wager. EUROLOTTO reserves the right to refuse or limit any wager.

Depending on the payment method used, eWallets and bank transfers will qualify immediately after receipt for withdrawal, whilst VISA or Mastercard payments will only qualify for withdrawal after having completed the full KYC procedures.

When funds in a Player Account are being used to play Games, deposited funds will be debited first, thereafter other funds (like bonuses and free spins).

5.1.1. General Conditions of Use E-voucher applying to Epro solution

  • E-PRO is a payment solution provided by EMP Corp, an E-money agent, based on E-money and E- wallet
  • E-PRO is an E-Voucher issued by EMP Corp, being resold by First Remit Limited (UK), a registered money service business with Her Majesty's Revenue and Customs certificate number 12679642 & fully authorized by the UK Financial Conduct Authority (FCA) as a payments institution, with reference 622935
  • E-Pro e-Vouchers resold by First Remit will show in your card statement as "Online Payment"
  • An E-VOUCHER, constituting electronic money, is generated in the event of an intervention by EMP Corp to pay for the services offered on the MERCHANT SITE
  • If the payment service provider is EMP Corp, the transaction will result in the creation and purchase of electronic money issued by an E-money Issuer, to be used to credit an E-wallet

5.2. Interest on deposited funds

The Player shall not treat EUROLOTTO as a financial institution and is not entitled to any interest on deposited funds and will be paid no interest on deposited funds.

5.3. Player access to funds stored in the Player's Account

EUROLOTTO shall action a transfer from the Player's Account a part or whole of the Player's funds, with deductions for eventual service fees, bank fees etc. to the bank account, credit card or e-wallet that the Player most recently registered at EUROLOTTO. Transfers are administered only during working hours set out by EUROLOTTO from time to time. Requests for transfers can be made at any time.

5.4. No loans and no exchange rate speculation

Funds on a Player's Account cannot be used as a basis for obtaining any form of credit, nor are they allowed to be used for exchange rate speculation. EUROLOTTO reserves the right to return funds to Players at the original exchange rate if EUROLOTTO has reasonable suspicion that the intent of the Player's transactions has been primarily to speculate on exchange rates or for any other purposes than to participate in the Games.

6.1. Withdrawal procedures

Withdrawals may be made to: VISA, VISA ELECTRON, MASTERCARD, MAESTRO, by bank transfer or through Moneybookers.

The Player may be requested a list of required documents before making a withdrawal request. EUROLOTTO will endeavour to process all requested withdrawals within 72 hours, providing that verification documents have been received. EUROLOTTO reserves the right to refuse a withdrawal and request additional documents by email. Bonus money will not be paid out from the Player's Account. Any withdrawal can be subject to random security checks to prevent fraudulent activity and money laundering.

EUROLOTTO reserves the right to ask for verification documents at any time, and we can temporarily suspend your account until we receive the required documents. EUROLOTTO carries out additional verification procedures and players having cumulative withdrawals exceeding 2,330 Euro will be requested to provide EUROLOTTO with personal documentation, such as but not limited to copies of identification documents, utility bills, credit cards, bank statements etc. A Player's Account might be closed permanently and or a withdrawal may be refused if a player does not provide EUROLOTTO with the required documents and or if the player is found to have supplied false or misleading information.

All documents that are sent to EUROLOTTO are confidential and will be handled under the data protection regulations (Malta Data Protection Act Cap.440). The reason why EUROLOTTO requires these documents is to guarantee the security for all Players and to prevent money laundering.

If the Player closes the Player's Account, all funds excluding any bonus money that might not be redeemable will be transferred to the bank account from where the funds originated.

EUROLOTTO actively endeavours to combat money laundering. Withdrawals from a Player's Account to the player will be made to the account from which the transfer to the Player's Account was made, if available. Exceptions may be made if this functionality is not possible.

In case where remittance of funds to an account from which deposits originated is not possible, withdrawals will be made to another account of choice following certain controls including but not limited to due diligence checks, anti-money laundering checks and anti-fraud checks.

It is the Players’ responsibility to provide sufficient and accurate banking information for EUROLOTTO to complete a transaction. If the information is not sufficient and accurate any additional fees or charges will be levied on the player.

The minimum amount that can be withdrawn is €20. Credit card or e-wallet transfers are not subjected to any fee. Bank transfer fees may vary and will be deducted from the withdrawal amount. Information regarding deposit and withdrawal limits, processing times, qualifications and processing
fees can also be found under the Payments & Bonuses section when logging into your Player Account.

Deposits and withdrawals of funds into and from Your Player Account, shall only be made using credit card and other financial instruments that are valid and lawfully belonging to You.

EUROLOTTO is required to retrieve a proof of the Player's identity for large withdrawals, in which case EUROLOTTO will contact the Player. EUROLOTTO will process the withdrawal once satisfactory proof has been received.

Each Player is solely responsible for reporting and paying any taxes as required by the governing law of the country of residence, if applicable.

Withdrawal of funds not used for wagering/betting shall not be allowed.

6.2.Payment of Large Wins

The Player understands and agrees that the payment of any jackpot prize of a game offered by a third party game provider may be the responsibility of the respective game provider. Specific terms and conditions may apply. The jackpot winning Player is recommended to contact customer support for more information.

Without prejudice to the foregoing, In the case of significant wins exceeding €5,000,000, for which EUROLOTTO is responsible for the payment thereof (see section 13) EUROLOTTO reserves the right to decide to pay the winning Player in accordance with the following re-payment plan:

The first 10% of the win will be paid by EUROLOTTO to the player immediately after KYC is collected and the identity of the Player verified;

The remainder amount of 90% will be paid by EUROLOTTO to the Player over a period of nine (9) years at the frequency decided at the sole and exclusive discretion of EUROLOTTO. This applies if there is no other specific payment plan in the Terms & Conditions for any Game. The longer time of the two should apply unless EUROLOTTO agrees on another payment plan.

Each Player is solely responsible for reporting and paying any taxes as required by the governing law of the country of residence, if applicable.

EUROLOTTO and the respective game provider reserve the right to publish the name of a PLAYER who makes a significant amount. If publication of the PLAYERS NAME can’t be made EUROLOTTO can deny to pay out the win.

7.1. The Player's ability to suspend the Player's Account

The Player can request suspension of the Player's Account for an arbitrary period of time. Excessive use of the suspend account feature, as set out by EUROLOTTO at any time, may at EUROLOTTO’s sole discretion lead to termination of the customer relationship at any time. The Player may set a limit / suspension on the account at any time by going to My Account and Restrictions (requires log in) to enter a limit for how much he/she can spend per week until a date in the future. Once saved, this will come into effect immediately.

7.2. The Player's ability to lock the Player's Account

The Player can request that the Player's Account is locked at any time. EUROLOTTO shall handle such requests during working hours as set out by EUROLOTTO from time to time. The Player may lock the account at any time by going to Account and Restrictions (requires log in) to enter a future date when the lock should expire. Once saved, this will come into effect immediately.

7.3. Revoking or changing a suspension or lock on a Player Account

The Player may request that a suspension or a lock set on a Player account to be changed or revoked. Such a request has to be submitted to EUROLOTTO in writing.

A request for decreasing the suspension or revoking the lock will not come into effect until 7 days after the request was submitted. Should a Player request to increase the exclusion period, this will come into effect immediately.

7.4. Inactive Accounts

EUROLOTTO reserves the right to charge an inactive account fee of 5.00 EUR or equivalent in the other currencies. An inactive account is a players' account having a real money balance that has not recorded any log in for a period exceeding 12 consecutive months. The administrative charge will be imposed on the player’s account. The first fee for an inactive account will be deducted following 12 months of inactivity. All consecutive fees for an inactive account will be deducted on a monthly basis until the player’s account balance reaches zero. All registered players will be notified at least 30 days prior to any fees being incurred that the inactive account fee is to be charged to their accounts. Holders of inactive accounts may instantly reactivate their accounts by logging in or withdrawing the funds within the 30 days' time window without incurring any fees. If after your account has become inactive, you access your account, EUROLOTTO may consider reimbursement of the fees charged if you can prove that you could not access your account due to a reasonable cause. CherryCasino reserves the right to increase the inactive account fee in line with the MGA.

If a players’ account having a real money balance has not recorded any log in for a period exceeding 30 consecutive months, it is said to be dormant. The balance on the players account, minus any bonus money, will be paid out to the player. If EUROLOTTO is unable to contact the player, the money will be forfeited and paid out to the MGA.

7.5. Recovery of funds on accounts

To recover funds on an account the player should request a withdrawal via the normal process or if such process is not possible the player should contact customer support.

8.1. Setting limits

As a responsible gaming measure, the Player has the ability to place financial limits on the amount of wagers and deposits. In the responsible gaming area under “My Account” the Player can set limits for daily, weekly and monthly deposits.

Players may choose to exclude themselves from playing any games on our Website. Players may:

  Set a limit on the amount possible to wager within a specified period of time.

  Set a limit on the losses incurred within a period of time;

  Set a limit on the duration of play within one session;

  Exclude themselves from playing for a definite or indefinite period.

A requested limit will have effect immediately the first time it is submitted or in case a prior limit is lowered. If the limit amount is increased or terminated, such change will have effect after a seven day cooling down period. A limit set by the player will be in effect until the player decides otherwise.

The player may close his player’s account by sending such a request to our customer support team. The customer support team will then finalize the closing of the player’s account. The player will be able to open his/her account again by sending a request to the customer support team. 9.1. Collection of personal data

EUROLOTTO is committed to protect your privacy and personal information. Personal and financial information of all players will be kept confidential. However, under applicable laws and gaming regulations EUROLOTTO is required to maintain a secure online list of all registered players which may be disclosed to the Authorities for scrutiny purposes. For the purposes of applicable data protection legislation the Player hereby consents to the processing of any and all personal data (in manual, electronic or any other form) in connection with the Player's transactions in relation to EUROLOTTO. With the Players' approval EUROLOTTO may use personal details for marketing purposes. EUROLOTTO undertakes that it shall not process any personal data relative to the Player for any purpose other than for administrating the Player's transactions with EUROLOTTO and marketing as approved by the Player.

EUROLOTTO also has the right to disclose the Player's personal information to relevant recipients if it is required to do so by law, or if EUROLOTTO believes in good faith that such disclosure is necessary to: (1) comply with and legal process served on the licensee or its gaming service; (2) protect the safety of other users of the gaming service or the public ; (3) investigate any suspected violations of the terms & conditions or license agreement, fraud or other similar and/or unlawful activity performed by the player.

10.1.Anti-Money laundry procedures

EUROLOTTO complies with the Prevention of Money Laundering Act and Regulations issued thereunder. EUROLOTTO shall report any suspicious transaction to the relevant competent authorities in Malta.

If the Player becomes aware of any suspicious activity relating to any of the Games of the Website, the Player must report this to EUROLOTTO immediately.

All transactions will be scrubbed by the system and checked using fraud tools available to help prevent any Money Laundry activity/attempt.

10.2. Fair-Play

EUROLOTTO prohibits player collusion and takes measures to prohibit use of devices, such as robots, that distort normal game play.

10.3. Consequences

EUROLOTTO may suspend, block or close the Player’s Account and withhold funds if requested to do so by the relevant authorities in accordance with the Prevention of Money Laundering Act or in the event that EUROLOTTO itself reasonably suspects that the Player is in breach of the Prevention of Money Laundering Act of Fair-Play rules. EUROLOTTO may also suspend, block or close the Player’s Account in the event of breach of any of the terms and conditions of this Agreement by the Player. Such suspension/blockage or closure shall not prejudice any of the Player’s rights lawfully obtained.

11.1. Transaction queries and limitation

Transactions can be queried at any time. Claims and requests to refute a transaction shall be made within thirty (30) days of the transaction in question. Failure to query or refute a transaction within thirty (30) days leads to the transaction being deemed valid and irrevocable.

11.2. Complaints and compensation

If a Player has any complaints, claims or disputes with regard to any outcome regarding the services or any other activity provided by EUROLOTTO, he/she must submit the complaint to EUROLOTTO in writing as soon as is reasonably practicable following the date of the original transaction to which the claim or dispute refers and within the time limit set out in the previous paragraph.

1. Introduction

When the Operator is placing the Bets with the Bookmaker in Curacao, the Player acknowledges that the Operator is acting in the name and on behalf of the Player. The Bookmaker sets the odds of winning and pays the Winnings to the Operator on behalf of the Player for the eventual payout to the Player.

2. Definitions

“Bet” – a bet on the outcome of an event with a determinable outcome, for example the result of a lottery offered by the Website

“Bookmaker” – Kootac N.V., a company which is officially licensed by the Government of Curacao to accept Bets on lotteries (license number #8048/JAZ2013-014). The Bookmaker acts as a bookmaker by determining the odds, and is also responsible for the payment of Winnings to the Operator for distribution to Players. “Booster Ball” – a function allowing players to place bets on matching the correct numbers with vastly improved odds to those normally offered.

“Boost-o-meter” – a slider where players can adjust their stake when playing the Booster Ball.

“DLTB” – members of the German lottery and pools who operate several lotteries, including the German lottery “Lotto 6 aus 49”.

“DLTB-Jackpot” – the aggregate amount payable by the DLTB in respect of all Winning Tickets in Prize Category 1 and/or 2 in respect of the relevant draw of the German lottery “Lotto 6 aus 49”, as announced by the DLTB or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the DLTB had there been a Winning Ticket in the relevant Prize Category/Categories and in respect of the relevant draw of the German “Lotto 6 aus 49”.

“DLTB Winning Ticket” – a winning ticket for each draw, organised by the DLTB ‘’Lotto 6 aus 49’’

“Euro Jackpot-Jackpot” – the aggregate amount payable by the DLTB or any co-organiser in respect of all Winning Tickets in Prize Category 1 in respect of the relevant draw of the lottery “Euro Jackpot”, as announced by the DLTB or any co-organiser or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the DLTB or any co-organiser had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Euro Jackpot Winning Ticket” – a successfully submitted and accepted Winning Ticket for the “Euro Jackpot” lottery in respect of the relevant and official draw.

“Euro Millionen-Jackpot” – the aggregate amount payable by the LAE or any co-organiser in respect of all Winning Tickets in Prize Category 1 in respect of the relevant draw of the lottery “Euro Millionen”, as announced by the LAE or any co-organiser or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the LAE or any co-organiser had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Euro Millionen Winning Ticket” – a successfully submitted and accepted Winning Ticket for the “Euro Millionen” lottery in respect of the relevant and official draw.

“Jackpot” – the maximum possible winning at the Operator in respect to the underlying draw of the relevant Prize Category/Prize Categories of the relevant lotteries or the sum thereof.

“Operator” –  EUROLOTTO

“Operator Winning Bet” – a winning Bet for a Bookmaker game, which was successfully submitted directly or indirectly, via Internet, telephone or other channels, and placed by Operator on behalf of the Player with Bookmaker, including possible winning Bets introduced through a third party to Operator and then placed by Operator on behalf of the Player with Bookmaker.

“Mega Millions-Jackpot” – the aggregate amount payable by the Mega Millions Consortium or MUSL or any (co-)organiser in respect of all Winning Tickets in Prize Category 1 in US dollars and in respect of the relevant draw of the US-lottery “Mega Millions”, paid out in 30 growing annual amounts according to the official rules (i.e. with 5%p.a.), or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the Mega Millions Consortium, MUSL or a (co-)organiser over 30 growing annual amounts (in case of the “annuity” option) had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Mega Millions Winning Ticket” – a successfully submitted and accepted Winning Ticket for the American “Mega Millions” lottery in respect of the relevant and official draw.

“MUSL” – the Multi-State Lottery Association, which organises shared lotteries including the “Powerball” and “Mega Millions” lotteries.

“Pay Out” – the amount, which the operator of a lottery underlying a Bookmaker game in respect to a correctly matched Bet of a relevant draw in a relevant Prize Category has to pay out or has already paid out.

“Powerball-Jackpot” – the aggregate amount payable by the MUSL or any (co-) organiser in respect of all Winning Tickets in Prize Category 1 in US dollars and in respect of the relevant draw of the US-lottery “Powerball”, paid out in 30 growing annual amounts according to the official rules (i.e. with 4% p.a.), or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the MUSL or any (co-)organiser over 30 growing annual amounts (in case of the “annuity” option) had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Powerball Winning Ticket” – a successfully submitted and accepted Winning Ticket for the American “Powerball” lottery in respect of the relevant and official draw.

“Superenalotto-Jackpot” – the amount payable by the organiser of Italian lottery (Sisal) under the name Superenalotto in respect of all Winning Tickets in Prize Category 1 in and in respect of the relevant draw of the “Superenalotto” lottery, as announced by the Italian lottery organizer, had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Superenalotto Winning Ticket” – a successfully submitted and accepted Winning Ticket for the Italian “SuperEnaLotto” lottery in respect of the relevant and official draw.

“Prize Category” or “Prize Tier” – the category relates to the amount of numbers correctly matched (including Super Numbers, Stars, Euro Numbers, Powerballs, Megaballs and/or Bonus Balls as applicable) and which result determines the Prize Category in respect of the relevant draw of a certain lottery or a related Bookmaker game.

 “Stake” – the sum of money the Player places on a bet in respect of a relevant game and for a certain Virtual Betting Ticket, including any service fees.

“Virtual Betting Ticket” – the electronic ticket displayer on the Website the compilation of which allows him to place bets on a lottery or lotteries of his choice.

“Website” – the Internet portal of the Operator, which is available at EuroLotto.com, and which may refer to other joint or mobile Websites, which are also operated by the Operator within the same or another domain or within the same or another brand, and any subdomains operated by the Operator.

3. Contractual Parties

When a Player participates in any game offered on the Website the Player is accepting to enter into two separate agreements as described below:

  1. When registering, and when placing an order for a bet, the Player is entering into a contract with the Operator for the following services: the use of the Website; the operation and management of the Player Account; the placing of Bets with the Bookmaker in Curacao on the Player’s behalf; the payment of the Player’s Stakes to the Bookmaker; and, the payout of any Winnings received from the Bookmaker to the Player.
  2. When the Operator places a bet with the Bookmaker on a Player’s behalf, the Player is directly entering into a contract with the Bookmaker which regulates the Terms and Conditions for all Bets placed; the rules of the games offered by the Bookmaker as well as the payout of any Winnings.

All references in these Terms and Conditions in relation to a Player placing a Bet or in relation to the placement of Bets refer to, unless otherwise regulated, the placing of a Bet by the Operator with the Bookmaker for and on behalf of the Player in Curacao.

4. Placing of Bets

4.1.

The Player effects an instruction to the Operator to place Bets with the Bookmaker on their behalf by filling out and submitting a Virtual Betting Ticket on the Website for their chosen Bookmaker Game/s.

To settle the Bet amount the Player may either use funds available in his Player Account or pay for the Bet/s by using the chosen payment method during check out.

4.2.

After the Player has filled out the Virtual Betting Ticket/s, the Bet/s transfer to the Player’s shopping cart. When the Player has finished placing bets he may then proceed to the Shopping Cart to effect payment.

4.3.

The Player then pays for their Bet/s by providing their payment details and by clicking on the applicable button in the shopping cart. Where the Player has a balance in his Account and chooses to settle the Bet from his balance, the bet amount is immediately deducted from the balance. The system will indicate to the Player if there are sufficient funds available in his Player Account and whether another payment method is required to be selected or not.

4.4.

The Operator does not offer credit betting and the player must either have funds in The Player Account or pay for the bet using the chosen payment method.

4.5.

Once any Bet has been submitted, it cannot be altered or cancelled.

4.6.

The Player will then receive an Order confirmation which would include details of the Bet placed. The Player may also review the full details of all bets placed by logging into their Player Account on the website and review Bet History or Active Bets as applicable.

4.7.

Depending on the selected Bookmaker game/s, the Player may bet for a certain duration (“Duration Bets”) and also extend the duration automatically. Stakes for Duration Bets will be debited by pre-payment at the beginning of the relevant duration for all relevant draws for the selected duration.

4.8.

The Player may automatically extend Bets by selecting the “Subscription” option which is available separately for each Bookmaker Game. Depending on the selected Bookmaker game the player may then select a period for the automated placing of Bets for a period ranging from 1 to 52 weeks. After this Subscription period has elapsed the Bets are once again renewed automatically for the selected period of Subscription, unless a notice of cancellation is received via the Player Account. The cancellation of a Subscription must be received by 23:59h of the day prior to the day the period for automated placing of Bets ends. Stakes for following Subscription Bets will be debited by pre-payment for every following period of the Subscription.

4.9.

The Operator is authorised to, in its sole discretion, instruct the Bookmaker to void any Bets, whether Active or Settled if

  1. the Operator was instructed to place a Bet/s after the relevant deadline or after the start of the relevant draw and/or if the Operator incorrectly accepted an instruction to place a Bet/s on the Website after the relevant deadline or after the start of the relevant draw
  2. the Operator was instructed to place a Bet by a Player who has provided false, incomplete or expired information associated with their Player Account or otherwise related to the Website or any the services available through it
  3. the Operator becomes aware of a genuine mistake in relation to a Bet or draw and is not able to contact the Player to correct the error or confirm the Bet prior to the deadline
  4. the Operator was instructed to place a Bet by a Player who is involved in any fraud-related activities relating to the placing of the Bet, the operation of the Player Account or relating to the Website or the services offered by the Operator
  5. the Operator was instructed to place a Bet by a Player who was, at the time of placing the Bet, less than 18 years old,
  6. the Player maintains more than one Player Account,
  7. in conjunction with any draw, fraud and/or technical and/or human error or unwarranted influence was found or
  8. the draw is declared by an organiser or co-organiser as being invalid.

5. Winnings

5.1.

Winnings on any Bookmaker Game/s shall be credited to a Player Account and the Player is able to view any such Winnings on their Player Account on the Website. The Winnings will be credited once these are received by the Operator from the Bookmaker. In addition, the Operator may decide, but is not obliged, to inform the Player with respect to Winnings by email, SMS/text message or other ways especially if there is a large win. Information about Winnings can be provided in euro (€), pound sterling (£) or U.S. dollars ($).

5.2.

The Operator will only transfer those Winnings to the Player, which have been paid out by the Bookmaker to the Operator. The Operator is required to only credit Winnings to a Player Account if the Operator received the Winnings from the Bookmaker and the Player is entitled to a Winning and, where applicable, the Insurers settle a claim for a Winning.

6. The Bookmakers Betting Rules

6.1.1 The Bookmaker will accept Bet/s placed by the Operator on behalf of the Player, where instructions to place the Bet/s have been submitted on the Website by the Player and the Bet/s has been subsequently placed with it by the Operator.

Any reference in this section of the Terms and Conditions of a Player shall mean a Player ordering a Bet with the Operator who is acting as the Player’s agent.

For avoidance of any doubt the Bookmaker is not an Underlying Lottery Operator. With the Bookmaker, the Player is placing Bets on the expected results of the drawings of certain lotteries, namely:

“SuperEnalotto”, operated by the Italian national lottery;
“Euro Millionen”, operated by the LAE;
“Euro Jackpot”, “Lotto 6 aus 49”, “Spiel 77”, “Super 6” and “Glücksspirale”, operated or co-operated by the German DLTB;
“Powerball” and “Mega Millions”, operated or co-operated by the US-American Mega Millions Consortium, MUSL or their co-organisers; and
“Lotería de Navidad”, operated by the Spanish Loterías y Apuestas del Estado.

6.1.2 Player acknowledge that the jackpot values displayed on the Website are approximate estimates of what the jackpot will be using certain assumptions, such as the current or future jackpot being won or rolled over. The displayed value is an estimate and is not legally binding. The Operator is not liable for any inaccuracies between the estimated jackpot and the actual jackpot.

6.1.3 The Bookmaker calculates the Winnings for each Bet. The calculation is different per Bookmaker Game and Prize Category.

6.1.4 By choosing the option “Jackpot Chaser” the Player may automatically choose to extend the Virtual Betting Ticket until the current Jackpot of the relevant Bookmaker Game’s highest Prize Category has been won. The period for withdrawal encloses only the next draw date.

6.1.5 The “When Jackpot” feature allows the Player to define the amount of Jackpot to be reached in the relevant Bookmaker Game in order to start his Bet participating in the Bookmaker Game.

6.1.6 The Player may select the “Boosterball” option. By selecting it, the Player is allowed to achieve Winnings that are much better when 3 numbers are matched than those achieved in the Bookmaker Game.

Winnings with the Boosterball option may reach up to a 1000-multiple of the amount of Stake selected using the Boost ' o' Meter Slider on the Website.

By selecting the Boosterball option, after having selected the numbers on a Virtual Betting Ticket, if three numbers selected in one Bet are matched to the winning numbers drawn in the respective Underlying Lottery, the Player will win the amount displayed when choosing the Stake amount using the Boost’o’meter, additionally to the Winning for an eventually reached Prize Category.

6.1.7 On one Virtual Betting Ticket, either the option DoubleJackpot or NumberShield can be played.

6.1.8 Winnings for Bets in the Prize Category 1 with NumberShield are calculated under the assumption that there had been no other Covered Bets and no Underlying Lottery Winning Tickets in that Prize Category for the particular draw. Winnings for Bets with NumberShield are therefore not shared.

6.1.9 If a Bet in the Prize Category 1 is with DoubleJackpot, the Winnings are doubled.

6.1.10 Every field displayed on the Virtual Betting Ticket, allowing the selection of the relevant number combination as described further below for each Bookmaker Game, represents one Bet. At least one Bet has to be selected on every Virtual Betting Ticket. The Stakes are displayed on each Virtual Betting Ticket.

6.1.11 Only the highest of the available Prize Categories achieved by and relevant to that Bet can be won on each Bet.

6.1.12 The Bet Deadline is displayed on the Website for each Bookmaker Game and the relevant available draw.

6.1.13 Payout of Prizes from Prize Categories to other Prize Categories. The below calculations apply assuming there was no Pay Out from Prize Category to other Prize Categories, due to no Underlying Lottery Winning Tickets in a Prize Category for one draw, due to no Underlying Lottery Winning Tickets in a Prize Category for a number of subsequent draws or due to a jackpot cap. Winnings are calculated as if there was no pay-out of Prizes to other Prize Categories.

6.1.14 Winnings in MegaMillions and PowerBall

As is common with the relevant Underlying Lottery Operator, the Operator may also pay out the Winnings in Prize Category 1 over 30 years (the “Annuity Option”). If the Operator chooses the Annuity Option, the first payment will be made as soon as possible after the draw, with the next 29 payments at one-year intervals. The level of payments is calculated such that the payments rise by 4% from year to year until the full amount of the Winning has been paid out. The option to pay out Winnings in one lump sum (“Cash Option”) is not available at the Operator at the time being.

Withholdings for Winnings in MegaMillions and PowerBall - The Operator retains withholdings of Winnings in the highest two Prize Categories in the amount of 35%, in order to put the Player in a similar economic position as if they had played the Underlying Lottery.

6.2.1.1 Lotto 6 aus 49 is a Bookmaker Game based on the German lottery “Lotto 6 aus 49” lottery operated by DLTB. Draws of the Underlying Lottery take place usually every Wednesday and Saturday.

6.2.1.2 When placing a Bet in the Bookmaker Game Lotto 6 aus 49, the Player selects six numbers (“Numbers”) from 1 to 49 in each Bet and one additional number (“Super Number”) from 0 to 9 applicable for all Bets on one Virtual Betting Ticket.

6.2.1.3 The Super Number is the last digit of the Play Slip Number (Ticket Number), displayed on the Virtual Betting Ticket. The Player may select a different than the preselected Super Number.

6.2.1.4 There are 9 different ways to win:

by matching 2 Numbers plus the Super Number (Prize Category 9)

6.2.1.5 The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 9 are 5,00 Euro.

6.2.1.6 The Winnings to be paid out in respect of each Operator Winning Bet in Prize Categories 3 to 8 are the amount of the Pay Out announced by the Underlying Lottery Operator in respect of an Underlying Lottery Winning Ticket in the relevant Prize Category. If the Underlying Lottery Operator has not announced a Pay Out in the respective Prize Category for the relevant draw of the Underlying Lottery, the Winnings payable in respect of each Operator Winning Bet in that Prize Category will be calculated on the basis of the aggregate amounts paid in for the relevant draw as announced by the Underlying Lottery Operator and its allocation to the winning Prize Categories.

6.2.1.7 The Winnings payable in respect of each Covered Bet in Prize Category 1 and 2 depend on the number of the Underlying Lottery Winning Tickets in the relevant Prize Category, the number of Covered Bets in the relevant Prize Category, the payable Pay Out by the Underlying Lottery Operator for the Underlying Lottery Winning Tickets in the relevant Prize Category as well as the amount of Jackpot for Prize Category 1 or the aggregate prize allocated for the Prize Category 2. The Winnings payable after withholdings in respect of that single Covered Bet in Prize Category 1 is $ 195.000.000,00.

Example 2
There is only one Covered Bet in Prize Category 1 and two Underlying Lottery Winning Tickets Bets have been announced in Prize Category 1 in respect of an Underlying Lottery Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of that single Covered Bet in Prize Category 1 would be $ 65.000.000,00.

Example 3

6.3.3 DinoLotto

Example 1
If there is one Covered Bet and one Underlying Lottery Winning Ticket in Prize Category 1 for the relevant draw, then the Winnings payable in respect of the Covered Bet in Prize Category 1 of the DinoLotto game would be € 25.000.000,00.

6.4 BoosterBall

6.4.1

Boosterball is designed to provide the Player with the option to generate winnings that are much better than those generated by the Bookmaker game when 3 numbers are matched.

6.4.2

Prizes offered range from €1000 to €10,000 and the Winnings would depend on the Stake amount selected using the Boost ‘o’ Meter Slider on the website.

6.4.3.

By selecting the Boosterball option, after having selected the numbers on a Virtual Betting Ticket, if three numbers are matched to the numbers drawn in the respective Lottery, the Player will win the amount displayed when choosing the stake amount using the Boost’o’meter, additionally to the normal payout for that prize category.

7.1 General Betting Rules

7.1.1.

The Bookmaker strives to ensure that all the jackpot values for all lotteries offered on the Website are correct, but assumes no responsibility for errors contained in such information. The Bookmaker estimates the amount of future jackpots using certain assumptions, such as the current or future jackpot being won or rolled over, but is not liable for false assumptions, calculations or forecasts.

7.1.2

By choosing the option “Jackpot Chaser” the Player may automatically choose to extend the Virtual Betting Ticket until the current jackpot of the highest Prize Category in respect to the underlying lottery of the relevant Bookmaker game has been won. The period for withdrawal encloses only the next draw date.

7.1.3

Valid Bets will be placed on the next relevant draw that takes place, provided that they are placed before the respective deadline and provided that the Player has not selected something else on purpose. The deadline will be displayed on the Website. It is up to the Player to make sure that the instructions are given to place the Bet before the relevant deadline. For the avoidance of doubt, instructions to place or the apparent placement of a Bet after the start of a specific draw or a draw that has actually occurred will not be valid, irrespective of any automatic confirmation, that may be generated via email or the Website, or irrespective of a wrong deadline displayed on the Website.

7.1.4

The “When Jackpot” feature will set Bets to enter/play a particular lottery only after the official lottery Prize Category 1 has exceeded the specified “When Jackpot” amount for the relevant draw.

If a lottery makes multiple draws on the same date, then unless otherwise specified by the Bookmaker, a Player's Bet will apply only to the main draw taking place on that date (or, where no main draw takes place, the first draw), under exclusion of any other draw made by the lottery in question.

7.1.6

If a lottery draw does not take place or no draw result is published or officially announced, all valid Bets on that draw will stand for the rescheduled draw (or, if there is none, the next available relevant draw).

7.1.7

The Operator shall pay out winnings up to 50 million units (Euro, $, etc) as one lump sum, any winnings over this amount shall be paid to the winner/s in equal yearly installments over a period of thirty (30 years).

8 Rights of the Bookmaker

8.1

A Player cannot claim any Winnings or payout from the Bookmaker and/or Bookmaker may at its discretion decide about the validity of a Bet or a Player's entitlement to Winnings or void a Bet if

  1. Bets were placed after the relevant deadline or after the start of the relevant draw;

  3. The Bookmaker becomes aware of an error in relation to that Bet or draw and is not able to contact the Player to correct the error or confirm the bet before the deadline;
  4. the Bet was placed on behalf of a Player who has provided false information in connection with their Player Account or otherwise in connection with the Website or the services available through it;
  5. the Bet was placed on behalf of a Player who has been involved in any fraud-related activities in relation to the placing of the bet, the operation of the Player Account or otherwise in connection with the Website or the services available through it;
  6. the Bet was placed on behalf of a Player who was less than 18 years old or was a director, officer, or employee (or their spouse or dependent) of the Bookmaker or of one of the Operator Group companies;
  7. the Player maintains more than one Player Account;
  8. in conjunction with any draw, fraud, technical and/or human error or unwarranted influence was found or
  9. the draw is declared by an organiser or co-organiser as being invalid.

Furthermore the Bookmaker may void a Bet if the Operator authorises or instructs it to do so.

8.2

When deciding if Winnings are to be paid out due to 12.1., Bookmaker may base its decision on information that is researched and/or held by Operator and forwarded to the Bookmaker. The Bookmaker is not obliged to carry out investigation on its own.

8.3

If any Bet is voided in accordance with Condition 12.1. (i), (ii), or (iii), the Bookmaker will offer the Operator, on behalf of the Player, the option of placing any such Bet on the next relevant draw or crediting the Player's Player Account with the relevant sum. If any Bet is otherwise voided by the Operator in accordance with these terms, the relevant sum associated with that bet may be forfeited to the Bookmaker, or except where the Bet was placed by a Player who is under the age of 18. In this case, the relevant sum will be repaid to the Operator on behalf of the Player.

8.4

The Bookmaker reserves the right:

  1. a) to set off the amounts of any unpaid Bets for Bets owed by that Player against a Player's Winnings;
  2. b) to terminate, vary or suspend any product offered on the Website, immediately and without prior notice, for any reason and at the Bookmaker’s sole discretion; and
  3. c) to require that, but shall not be obliged, the relevant Player provide identification documents in order to enable the Bookmaker to satisfy itself as to the validity of Player Account details and the Player's entitlement to the Winnings in accordance with these Terms and Conditions. The Bookmaker may withhold payment of Winnings until any such matter has been fully resolved.

8.5

The Bookmaker decides about acceptance of a Player’s Bet prior to the beginning of the draw. If the Bookmaker does not accept a Bet, the Player will be reimbursed accordingly.

8.6

The Operator has the right to hedge against placed Bets by purchasing tickets in its own name or its representatives names in corresponding lotteries in which Players would have placed bets, irrespective of whether the Prizes on offer are insured or not.

9. Commitment to Decisions

9.1

In the event of a dispute in respect of a Bet or the payment or awarding of any Winnings, the Bookmaker may withhold payment of the Winnings until any dispute has been fully concluded.

9.2

Where the Bookmaker makes a final decision or exercises any discretion referred to above, the Bookmaker may, solely at its discretion and notwithstanding Condition 13, reimburse the sum paid by the Player for the relevant Bet or offer a new Bet to the Player.

10. Liability of Bookmaker

10.1.

The Bookmaker shall not be liable for any loss or damage that may arise from the insolvency of third parties, including the Operator or any bank, including (without limitation) any bank with which the Bookmaker maintains its accounts.

10.2.

The Bookmaker’s liability to the Player and/or in regards to the Player’s Winnings is fully discharged upon payment being made by the Bookmaker to the Operator. For clarification: the Bookmaker is, under no circumstances, obliged to pay Winnings directly to Players, or to any party other than the Operator. The Bookmaker is furthermore not obliged to payout Winnings, if the Player has no such claim according to these Terms and Conditions.

10.3.

Any liability that the Bookmaker has towards a Player other than an obligation to pay Winnings to the Operator on behalf of the Player for successful and valid Bets placed by the Operator on behalf of the Player and submitted and accepted according to these Terms and Conditions is limited:

  • in the case that the liability refers to a Bet: to the total amount of the Player’s Stake in regards to that specific Bet
  • in all other cases: to the amount of Euro 5.000,00 (five thousand Euros).
